SALTY GMBH

 

§1 Scope of application

The terms and conditions listed here apply to all offers and services such as camps or other events that are carried out or organized directly by SALTY GmbH (hereinafter referred to as "SALTY"). These may be on-site events as well as online events. 

 

§2 Delimitation

Depending on the trainer/coach booked or requested, SALTY may also forward the booking to the relevant trainer/coach. In this case, the contract is then concluded directly with the respective trainer/coach. The conditions listed here do not apply to this contractual relationship. 

 

§3 Registration/booking

The registration or booking of trail running camps or other events (hereinafter collectively referred to as "events") is made by e-mail or via the contact form on the website www.saltytrailrunning.com The registration or booking is binding. The contract is concluded upon acceptance by SALTY. Acceptance does not require any particular form. After successful registration or booking, you will receive a confirmation of registration.

 

§4 Fees

Unless otherwise stated, fees for events must be paid on the day of the event at the latest.

In the case of events lasting several days or events with external dependencies (e.g. reservation of event venue etc.), this may vary and a longer payment term may be specified. This will then be noted accordingly on the registration confirmation or invoice.

Payment shall be made by bank transfer to SALTY's bank account. The relevant account details are included on the order confirmation or invoice. 

§5 Personal capacity of the participants

In their own interest, event participants are expressly requested to assess themselves self-critically. The minimum age for participation in events is 18 years, unless otherwise stated for individual courses. In the case of minors, we generally require a declaration of consent from a parent or legal guardian.

 

§6 Health of the participants

Participants declare to SALTY that they are adequately insured against accidents and that they are not currently aware of any facts relating to their health that would preclude their participation in the event. 

A medical examination is recommended before the start of an event, especially for new and returning participants. The guide should be informed of the doctor's recommendations before the start of the event.

Should any sudden health or mental disorders occur during the event/training, the participant is obliged to inform SALTY immediately.

 

§7 Material

For on-site events, participants receive an equipment list in advance that is tailored to the respective course or training requirements. This list is binding, as the success and safety of an event depend to a large extent on the correct equipment.

If test material is provided as part of an event, it must be returned immediately after the event. Willfully damaged or lost items must be replaced by the participant.

 

§8 Program changes

The training sessions advertised or offered as part of an event are carefully prepared by SALTY or the respective trainer/coach. Nevertheless, weather conditions, conditions found on site or the composition of the group sometimes force a change to the program. This is no reason for a reduction in the course fee. SALTY reserves the right to make changes to the event at short notice, e.g. course mergers, course changes and personnel changes.

 

§9 Exclusion, early departure

The trainers/coaches entrusted by SALTY with the implementation of the event are entitled to exclude individual participants, for example if they have incorrectly assessed their personal performance or if health aspects speak against participation in the event. If a participant leaves early or is excluded by the trainer/coach, there is no entitlement to a refund of the course fee.

 

§10 Withdrawal by the participant

For booked events with longer payment terms, the participant may withdraw from the contract at any time before the start of the event without giving reasons. Decisive is the receipt of the declaration of withdrawal in text form by SALTY. If the participant withdraws from the contract, SALTY can demand compensation for the arrangements made and expenses incurred, whereby normal, saved expenses and normal other uses of SALTY's services are taken into account. The SALTY reserves the right to apply a lump sum to the compensation claim to which the SALTY is entitled as follows: In the event of withdrawal up to 14 days before the start of the event, SALTY's claim for compensation is 50% of the event fees; in the event of later withdrawal, 100% of the event fees. Proof of higher costs or damages by SALTY remains unaffected. If cancellation fees are incurred for the accommodation booked by or for the participant, these are to be paid in full by the participant.

 

§11 Withdrawal by SALTY

SALTY may withdraw from the contract for good cause. Important reasons are e.g. force majeure, illness of non-replaceable personnel, safety reasons, due to legal regulations or lack of participation. In these cases, the participants will be informed by SALTY. In this case, the course fee paid will be refunded in full. Claims for damages are excluded in this respect.

 

§12 Liability

Courses and events that take place in the field of mountain sports (e.g. trail running camps) always involve risks to people or objects. There is no such thing as one hundred percent safety in mountain sports. Participation in SALTY events is always at the participant's own risk and responsibility. A separately signed disclaimer is required for this type of event. This will be handed out or sent in good time before the event. 

It is expressly recommended that you do not carry any valuables or large sums of money. The organizer accepts no liability for loss or damage.

 

§13 Rights to image & video material

As part of SALTY events, image, sound and video recordings of the event and individual participants may be made by SALTY or commissioned third parties. By registering for an event, the participant consents to the (promotional) use of this image, sound and video material for all known types of use, in particular on the SALTY website and in print media. The participant can revoke their consent at any time with effect for the future by sending a declaration to SALTY in text form. An objection declared before the start of the event has no effect on participation in the event.

 

§14 Applicable law, place of jurisdiction

The law of the Federal Republic of Germany shall apply to this agreement for domestic contracting parties to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a registered trader within the meaning of the German Commercial Code, a legal entity or a special fund under public law, the place of performance and exclusive place of jurisdiction for all disputes arising from the business relationship shall be Traunstein.
